Licensing & Disclosures

Employer Risk Advisory, LLC · Chandler, Arizona

Licensing

  • Employer Risk Advisory, LLC maintains resident property & casualty producer licensing and adds nonresident licensing in each state where a placement requires it.
  • State license numbers are furnished on request. Email desk@employerriskadvisory.com or call the desk and we will provide the record for the state in question.

Producer compensation

  • ERA is compensated by the contracted PEO, ASO, or insurance carrier on placements it facilitates. Compensation terms match direct-market schedules and do not vary by which contracted market wins the placement, so routing is appetite-driven rather than compensation-driven.
  • Where a submission reaches ERA through another intermediary, a second layer of intermediary compensation may apply and is disclosed to the producer under agreement. Full commission terms are provided to appointed producers under agreement.

Underwriting authority

  • ERA does not rate, quote, bind, or issue coverage. Every indication is the named market's, on that market's paper, presented by ERA alongside the producer of record.

Surplus lines

  • Where a placement is made with a non-admitted insurer, the coverage is placed under the surplus lines laws of the applicable state. Non-admitted insurers are not subject to that state's rate and form filing requirements, and in the event of insurer insolvency, losses are generally not protected by the state guaranty fund. Applicable surplus lines taxes and fees are disclosed on the placement documents.

Errors & omissions and confidentiality

  • ERA maintains professional errors & omissions coverage on the brokerage entity, executes a HIPAA Business Associate Addendum as part of every producer agreement, and treats client census, benefits, and loss data as confidential.

Nature of site content

  • Appetite statements, class family lists, mod ceilings, premium bands, and turnaround statements describe the general working parameters of ERA's contracted panel. They are not underwriting commitments, and every account is underwritten on its own facts by the market that writes it.
